Terms of Service

1. Who we are

FixMyPivot is operated by FixMyPivot LLC, a Montana limited liability company ("FixMyPivot," "we," "us," or "our"). FixMyPivot is an AI-powered guide for beginner and intermediate troubleshooting of center pivot irrigation systems, pumps, and related equipment. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.

2. Informational only — not professional advice

FixMyPivot provides general troubleshooting information. It is not engineering, electrical, or professional repair advice, and it is not a substitute for a qualified service technician or licensed electrician. AI-generated guidance can be incomplete or wrong. You are responsible for verifying any step before acting on it.

3. Safety and assumption of risk

Center pivot systems operate on high-voltage electricity and heavy moving machinery that can cause serious injury or death. You agree to: shut off and lock out power at the main disconnect before opening any panel or touching electrical components; attempt only work you are qualified and comfortable performing; and stop immediately and contact a local pivot service technician or a licensed electrician with agricultural experience whenever you are unsure or feel unsafe.

YOU USE THE SERVICE AND PERFORM ANY PHYSICAL WORK ENTIRELY AT YOUR OWN RISK. You knowingly assume all risk of injury, death, or property damage arising from work you perform, including work you perform after consulting the service.

4. No in-person or emergency services

FixMyPivot is a software service only. We do not perform, arrange, supervise, dispatch, or accept responsibility for any in-person inspection, maintenance, or repair work, and we are not an emergency or on-call service. Nothing in these terms or in the service creates a contractor, technician, engineering, or professional services relationship between you and FixMyPivot. If your situation requires hands-on work, or requires attention sooner than you can safely wait, contact a local pivot service technician or a licensed electrician with agricultural experience.

5. Your account

You must be at least 18 years old. Keep your login credentials confidential; you are responsible for activity under your account. One account per person.

6. Trials, subscriptions, and automatic renewal

New accounts receive a free trial. After the trial, continued access requires a paid subscription billed through Stripe.

YOUR SUBSCRIPTION RENEWS AUTOMATICALLY. A monthly plan renews every month and an annual plan renews every twelve months, at the price shown when you subscribed, charged to your payment method on file, until you cancel. You may cancel at any time in Settings or through the billing portal link in your receipt email. Cancellation stops all future charges; access continues through the end of the period you already paid for.

We will tell you before your free trial ends. Except where required by law, payments already made are non-refundable, including for partial periods. If we change the price of your plan, we will notify you by email before the change takes effect on your next renewal, and you may cancel before then.

7. Acceptable use

You agree not to: misuse or attempt to circumvent the service's limits or safeguards; probe, scrape, reverse-engineer, or resell the service; upload content you do not have the right to share; or use the service for anything unlawful.

8. Your uploads

You keep ownership of documents you upload. You grant FixMyPivot a limited license to store and process them solely to provide the service to you. You are responsible for having the right to upload what you upload.

9. Copyright and takedown requests

We respect copyright. Do not upload manuals, schematics, or other material you do not have the right to share. If you believe material on the service infringes your copyright, send a notice to the support address listed in the app that includes: your contact information; identification of the work you say is infringed; identification of the material in question and where it is; a statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law; a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner; and your physical or electronic signature. We remove infringing material and terminate the accounts of repeat infringers.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the service will be accurate, complete, uninterrupted, or error-free.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FIXMYPIVOT LLC AND ITS MEMBERS, OFFICERS, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR PERSONAL INJURY, DEATH, CROP LOSS, LOST PROFITS, OR PROPERTY OR EQUIPMENT DAMAGE, arising from your use of the service or from any work you perform. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or one hundred dollars ($100).

Some states do not allow the exclusion or limitation of certain damages, so parts of the above may not apply to you. In that case, our liability is limited to the smallest amount permitted by law. Nothing in these terms limits liability that cannot be limited by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless FixMyPivot LLC and its members, officers, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of: work you perform on any equipment; your violation of these terms or of any law; content you upload; or injury or damage to any third party, including anyone you allow to assist you, arising from your use of the service.

13. Termination

You can delete your account at any time in Settings. We may suspend or terminate accounts that violate these terms. Sections that by their nature should survive termination — including sections 3, 8, 10, 11, 12, and 14 — continue to apply after your account ends.

14. Governing law and disputes

These terms and any dispute arising out of them or out of your use of the service are governed by the laws of the State of Montana, without regard to its conflict of laws rules. You and FixMyPivot agree that any such dispute will be brought exclusively in the state or federal courts located in Montana, and you consent to personal jurisdiction and venue in those courts. If any provision of these terms is found unenforceable, that provision is limited or removed to the minimum extent necessary and the rest remain in full effect.

15. Changes to these terms

We may update these terms. If a change is material, we will notify you by email at the address on your account, or by a notice in the app, at least 14 days before it takes effect, and we will update the date at the top of this page. If you do not agree to a change, cancel your subscription and stop using the service before it takes effect; continued use after that date means you accept the updated terms.

16. General

These terms, together with the Privacy Policy, are the entire agreement between you and FixMyPivot regarding the service, and replace any earlier understanding. You may not assign or transfer your account or these terms; we may assign them to a successor in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver of it. Legal notices to you may be sent to the email address on your account; notices to us go to the support address listed in the app.
